At Paparoa Street School, we support the fair and proper treatment of kaimahi in all aspects of their employment and build employment relationships that are based on
good faith. Every kaimahi has a written employment agreement and we ensure that all decisions concerning employment (e.g. hours of work, leave) are made in accordance with the applicable employment agreement and relevant legislation.
When making an appointment, we:
We consider the requirements of legislation, employment agreements, and kura policies.
If there is a concern related to the employment agreement (e.g. dispute about the meaning or application of the employment agreement), the kaimahi can raise this with the tumuaki and/or poari matua. Kaimahi can also seek external support. See Raising Concerns and Complaints.
If the kura is considering whether to offer the tumuaki or kaiako different employment terms or conditions from those set out in their employment agreement, the poari matua seeks approval from the Ministry of Education.
Collective agreements
Paparoa Street School kaimahi may be covered by a collective agreement, which sets the terms and conditions of employment for union members whose work is included within the coverage clause of the agreement. Terms and conditions of collective agreements are negotiated by a union on behalf of kaimahi (e.g. kaiako or support kaimahi).
At Paparoa Street School, new kaimahi starting a position covered by a collective agreement are employed under terms consistent with that collective agreement for the first 30 days of their employment, as well as any additional terms mutually agreed between the kura and the new kaimahi (Employment Relations Act 2000, s 62).
Paparoa Street School provides information about union membership to new kaimahi. We provide new kaimahi with a form within the first 10 days of their employment to indicate whether they would like to join a union. We return the form to the relevant union unless the new kaimahi objects (Employment Relations Act 2000, s 62A).
If a kaimahi chooses not to join a union within 30 days of their employment, they are employed under an individual employment agreement.
Individual employment agreements
Kaimahi may have an individual employment agreement (IEA) if they are not a member of a union or if they are in a role not covered by a collective agreement.
If a role would be covered by a collective agreement but the kaimahi chooses to have an IEA, the IEA provides terms and conditions that are equivalent to or better than the terms and conditions of the relevant collective agreement.
