Third-Party Use of Kura Property

Kura property (buildings and/or grounds) may be available for use by third parties. For this policy, "third party" means any individual or group that wants to use the kura for non-kura activities, and who does not already have authority for use.

The use of kura property for third-party activities unrelated to day-to-day kura business must be approved by the poari matua for casual use, and by the poari matua and the Ministry of Education for lease. Considerations for approval include:

Requests and agreements

Any third party who wants to use kura property should apply to the kura in writing. The kura decides whether to approve the request and determines whether the requested property use would require a casual use agreement or lease agreement, according to Ministry criteria. Approval

Applications for casual use are submitted in writing to the kura. The poari matua considers these applications and responds in writing, or may delegate this responsibility to the tumuaki. If it is determined that an application would require a lease agreement, the poari matua and the Ministry are responsible for final approval, and the poari matua cannot delegate this responsibility. Once a decision is made, the kura responds in writing.

Other approval processes may apply to certain third-party uses of the kura.

Casual use agreements

If the kura approves a request that meets Ministry criteria for casual use, the kura creates an agreement using the required Ministry Casual Use Agreement.

Lease agreements

Applications that do not meet the criteria for casual use require a lease agreement and must be approved by the poari matua and the Ministry of Education. If the poari matua approves a request that requires a lease agreement, they submit the required Third Party Occupancy Application Form to the appropriate Ministry of Education property advisor. If approved by the Ministry, the Ministry creates a lease agreement outlining the conditions of use.

When a lease agreement ends or comes up for renewal, the poari matua advises the Ministry of Education property advisor and completes the relevant documentation.

Any issues, including damage to kura property, are managed according to the written agreement. If necessary, the kura may seek advice from the Ministry of Education, NZSBA, and/or a legal advisor.
